Section 7b-1. Purpose.

This ordinance is for the purpose of enacting a modern code of regulations concerning the use and possession of controlled substances and drug related paraphernalia.

Section 7b-2. Conflicting Ordinances Repealed.

All ordinances of Grantsville City in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict.

Section 7b-3. Utah Controlled Substances Act adopted.

The "Utah Controlled Substance Act" enacted by the State of Utah and compiled, prepared and published in Chapter 37 of Title 58 of the Utah Code Annotated, 1953, as amended to the date of this Ordinance, three copies of which are on file in the office of the City Recorder for use and examination by the public, and including any amendments or additions, from time to time as are made by the State of Utah, are hereby approved and adopted by reference as a part of the Grantsville City Code, to the same effect and extent as if said Act were copied herein in full, except for the expectations stated in Section five herein.

Section 7b-4. Utah Drug Paraphernalia Act adopted.

The "Utah Drug Paraphernalia Act", enacted by the State of Utah and compiled, prepared and published in Chapter 37a of Title 58 of the Utah Code Annotated, 1953, as amended to the date of this Ordinance, three copies of which are on file in the office of the City Recorder for use and examination by the public, and including any amendments or additions, from time to time as are made by the State of Utah, are hereby approved and adopted by reference as a part of the Grantsville City Code, to the same effect and extent as if said were copied herein in full, except for the exceptions stated in Section Five herein.

Section 7b-5. Exceptions

Excepted from this enactment by reference are all provisions of Chapter 37 and 37a of Title 58, Utah Code Annotated 1953 as amended from time to time which deal with offenses or matters that are Class "A" misdemeanors or felonies of any degree.

Section 7b-6. Penalties.

Any person violating the provisions of this Ordinance shall be deemed guilty of a Class "B" misdemeanor and shall be subject to a fine in an amount not to exceed $299.00, or by imprisonment in the Tooele County Jail for a period not to exceed six (6) months, or by both such fine and imprisonment.

Section 7b-7. Effective Date.

In the opinion of the City Council, this Ordinance is necessary for the immediate preservation of the peace, health, safety, and welfare of the residents of Grantsville City and shall take effect immediately upon posting. (Posted 3-22-82)
