Section 14b-1. Purpose.

Grantsville City has determined that salvage and junkyards pose a potential hazard to Grantsville City and its residents, if left unregulated. Such hazards include potential fire hazards; sources of contamination or pollution to water, air or property and are a habitation for insects and rodents. Grantsville City has also found that salvage and junkyards are unsightly. This ordinance is therefore for the purpose of promoting the public safety, health, and welfare; to ensure the enjoyment of public and private property and to preserve the scenic beauty of Grantsville City, by adopting and enforcing reasonable regulations relating to salvage and junkyards.

Section 14b-2. Definitions.

As used in this Chapter:

    1. Junk: means old or scrap copper, brass, rope, rags, batteries, paper, trash, rubber debris, waste or junked dismantled, or wrecked automobiles or motorcycles or parts thereof, iron, steel, and other old or scrap ferrous or nonferrous material.
    2. Salvage yard or junkyard: means any place, establishment, or business maintained, used or operated for storing, keeping, buying or selling junk or for the maintenance or operation of an automobile graveyard.
    3. Automobile graveyard: means any establishment or place of business which is maintained, used or operated, for storing, keeping, buying or selling wrecked, scrapped, ruined or dismantled motor vehicles or motor vehicle parts.

Section 14b-3. Salvage yard regulations.

No person shall establish, operate, own or allow a salvage yard or automobile graveyard to exist within Grantsville City, unless said yard complies with the following regulations:

      1. Salvage yards shall fully comply with applicable zoning ordinances.
      2. Salvage yards shall be entirely enclosed within a fenced area. The fence shall be constructed of wood, chain link or other similar material and shall be at least six feet high, with slats or other durable opaque covering, which completely screens the enclosed area. Salvage yards operating within Grantsville City at the time the adoption of this ordinance shall be entirely fenced pursuant to the provisions of this subsection, within twenty-four months of the effective date hereof. Salvage yards, which are established after the effective date of this ordinance, shall be entirely fenced pursuant to the provisions of this subsection prior to operation.
      3. Junk shall at all times be kept within a fenced enclosure as described in subsection (2) above, or within a totally enclosed building.
      4. Salvage yards shall be kept free of trash and weeds.
      5. Fire lanes shall be maintained in all salvage yards. Fire lanes shall be at least twelve feet wide and shall be situated so that no area of salvage yard is any more than 24 feet away from the nearest fire lane. Junk shall be kept at least four feet away from all exterior fences.
      6. Uncrushed automobiles shall not be stacked upon top of each other more than two high. Crushed automobiles shall not be stacked more than three high.

Section 14b-4. Criminal penalties.

Any salvage yard that is maintained in violation of the provisions of this chapter is hereby declared to be a nuisance and any non-complying condition may be abated pursuant to the procedures established in Chapter 14a. Any person, who fails to timely comply with a notice to abate a nuisance as defined herein, shall be guilty of an Infraction. Each day that a violation of the provisions of this Chapter continues shall constitute a separate offense.
